This product is for off-road use only by riders ages 16 and older, up to 220 pounds. Helmet and gloves recommended for use. 

Important: Please read these Official Rules before entering this Promotion. By participating in this Promotion, you agree to be bound by these Official Rules and represent that you satisfy all of the eligibility requirements below.

NO PURCHASE OR PAYMENT IS NECESSARY TO ENTER OR WIN THIS PROMOTION. MUST BE 18 OR OLDER TO WIN. 

The PAPÉ MACHINERY AG & TURF EGO POWER+ MINI BIKE SWEEPSTAKES (the “Promotion”) is sponsored by The Papé Group, Inc. (“Sponsor”), located at 355 Goodpasture Island Rd, Eugene, OR 97401.

1. Eligibility: Open to legal residents of Washington, Oregon, Idaho, Nevada, and California who are (i) at least age 18 (or the age of majority in their jurisdiction of residence, whichever is older) and (ii) subscribe to the official YouTube Channel or follow the official Instagram or Facebook accounts of Papé Machinery Agriculture & Turf. Directors, officers, members, managers, and employees of Sponsor; Google LLC; Meta Platforms, Inc.; and any of their respective parent companies, affiliate companies, subsidiaries, agents, professional advisors, advertising, promotional, public relations, and fulfillment agencies, consultants, legal counsel, website providers, web masters, and immediate family members (spouse, parent, child, sibling, grandparent, and “step” child, wherever they may live) are not eligible to enter the Promotion or win any prize. To be eligible to win a prize, entries must be completed and received by Sponsor in the manner and format designated below and otherwise comply with these Official Rules. PROMOTION IS IN NO WAY SPONSORED, ENDORSED, ADMINISTERED BY, OR ASSOCIATED WITH, YOUTUBE, INSTAGRAM, FACEBOOK, OR META.

2. Promotion Period: Promotion starts at 8:00AM Pacific Time (“PT”) on November 15, 2024 and ends at 11:59PM PT on December 1, 2024. (“Promotion Period”). Sponsor’s or its designee’s computer is the official time-keeping device for the Promotion. All entries must be received during the Promotion Period unless otherwise stated in these Official Rules and meet other requirements in these Official Rules to be eligible to win a prize. Proof of submission does not constitute proof of receipt by Sponsor.

3. How to Enter: To enter, complete the steps as instructed for any of the following channels of entry during the Promotion Period:

1. log in to your YouTube account and subscribe or verify that you are already a subscriber of the Papé Machinery Agriculture & Turf YouTube channel at youtube.com/@papemachinery.agturf. Ensure your YouTube subscription is made public; or
2. log in to your Instagram account and follow or verify that you are already a follower of the Papé Machinery Ag & Turf Instagram account at instagram.com/papemachinery.ag.turf/. Ensure that your Instagram account is set to public; or
3. log in to your Facebook account and follow or verify that you are already a follower and/or Like the Papé Machinery Ag & Turf Facebook page at facebook.com/PapeMachineryAgandTurf/.
   1. Upon completion of all required entry steps, you will automatically receive one entry into the Promotion.

Limit: ONE ENTRY PER PERSON PER CHANNEL DURING PROMOTION PERIOD. Any attempt to obtain additional entries, including through multiple or duplicate accounts will result in disqualification.

4. Identity of Entrant: All entries must be submitted by the individual entrant. Bulk or automated entries will be disqualified (including entries made using any script, macro, bot, or promotional service). Multiple participants are not permitted to share the same e-mail or social media account for entry. Any attempt to obtain additional entries through fraud or other illegitimate means will result in disqualification, at Sponsor’s discretion.

If there is a dispute about the identity of the entrant, entries will be declared made by the authorized account holder of the e-mail address or social media account submitted or associated with the entry. An “authorized account holder” means (i) the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address or (ii) if no e-mail address is associated with the entry, the natural person assigned to the primary e-mail address designated on the social media account submitted or associated with the entry. A potential winner may be required to provide Sponsor with proof that a potential winner is the authorized account holder of the account associated with the winning entry.

5. Winner Selection and Notification: On or about December 2, 2024, one potential winner will be selected by Sponsor or its designee via a random drawing from among all eligible entries. The odds of winning depend on the number of eligible entries received. Potential winners will be notified via tagged YouTube Community post, Direct Message on Instagram, or Direct Message on Facebook.

To the fullest extent permitted by applicable law, the potential winner may be required to sign and return within seven days of being notified, an Affidavit of Eligibility and Liability/Publicity Release, tax forms and/or other reasonable documentation. If (i) the attempted notification is returned as undeliverable without a forwarding address; (ii) any requested documents are not returned within seven days, including the Affidavit of Eligibility and Liability/Publicity Release or tax forms; or (iii) if winner is otherwise unable to accept the prize as stated, the prize will be forfeited and may be awarded to an alternate winner. Only three alternate drawings will be held for the prize, after which such prize will remain unrewarded. If, by reason of a print or other error, more prizes are claimed than the number set forth in these Official Rules, an alternate winner will be selected in accordance with the above selection process from among all eligible claimants making purportedly valid claims to award the stated number of prizes available. The potential winner is subject to verification by Sponsor, whose decisions related to the Promotion are final and binding. An entrant is not a winner of the prize unless and until entrant’s eligibility has been verified and entrant has been notified that verification is complete.

6. Prize: One winner will receive one prize package consisting of an EGO POWER+ Mini Bike and two 56V 7.5Ah EGO batteries (approximate retail value $2,000). ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZE ARE THE SOLE RESPONSIBILITY OF THE WINNER. Prize not transferable. No substitutions or exchanges of the prize will be permitted, except that Sponsor reserves the right to substitute a prize of comparable or greater value for the prize. All costs not explicitly set forth in these Official Rules are the sole responsibility of the winner. Only the stated number of prizes are available to be won in the Promotion. Except for applicable manufacturer’s standard warranties, prize is awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose).

7. Privacy; Name and Likeness Release: See Sponsor’s Privacy Policy at https://www.pape.com/privacy-policy. Except where prohibited by law, submitting an entry to the Promotion constitutes permission to use entrant’s name, city of residence, biographical information, likeness (and in the case of the winner, photos, images, and audio and video recordings) and other indicia of persona (“Information”), without limitation, in connection with the Promotion (including as part of the publicly-distributed Promotion award list) and for Sponsor's advertising, marketing, and promotional purposes without further permission or compensation. As a condition for accepting a prize, you must grant to Sponsor and its assigns, agents, and those acting with its permission the right to photograph, record, and film you in connection with delivery of the prize and otherwise create material incorporating Information into any of Sponsor’s or its assignees’ promotional, informational, or other materials, including in, but not limited to, photographs, video recordings, electronic media, on Internet web sites, or on social media web sites and platforms, and acknowledge Sponsor’s ownership of such materials.

By entering this Promotion, you consent to being contacted by Sponsor for any purpose in connection with this Promotion and for marketing and advertising purposes.8. General Terms and Conditions: EACH ENTRANT AGREES THAT (1) ANY DISPUTES, CLAIMS, AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THIS PROMOTION OR ANY PRIZE AWARDED WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION, AND EXCLUSIVELY BY THE UNITED STATES DISTRICT COURT FOR THE DISTRICT OF OREGON OR THE APPROPRIATE STATE COURT LOCATED IN EUGENE, OREGON (2) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, BUT IN NO EVENT ATTORNEYS’ FEES; AND (3) UNDER NO CIRCUMSTANCES WILL THE ENTRANT BE PERMITTED TO OBTAIN AWARDS FOR, AND WAIVES ALL RIGHTS TO CLAIM, INDIRECT, PUNITIVE, INCIDENTAL AND CONSEQUENTIAL DAMAGES AND ANY OTHER DAMAGES, OTHER THAN FOR ACTUAL OUT-OF-POCKET EXPENSES, AND ANY AND ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED. ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THIS AGREEMENT AND THE PROMOTION, OR THE RIGHTS AND OBLIGATIONS OF SPONSOR AND MYSELF IN CONNECTION WITH THIS PROMOTION ARE TO BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF OREGON, WITHOUT REGARD TO CHOICE OF LAW OR CONFLICT OF LAW RULES. YOU WAIVE ANY AND ALL (1) OBJECTIONS TO JURISDICTION AND VENUE IN THESE COURTS AND HEREBY SUBMIT TO THE JURISDICTION OF THOSE COURTS, AND (2) RIGHT TO TRIAL BY JURY IN ANY LEGAL PROCEEDING ARISING OUT OF OR RELATING TO THE OFFICIAL RULES, THE PROMOTION, OR ANY CLAIMS HEREUNDER.

This Promotion is subject to all applicable state and federal laws and is void where prohibited. Any provision of these Official Rules deemed unenforceable will be enforced to the extent permissible, and the remainder of these Official Rules will remain in effect. Sponsor reserves the right to amend these Official Rules or to terminate this Promotion. Sponsor’s failure to enforce any term of these Official Rules will not constitute a waiver of that provision. Entrants who violate these Official Rules, violate any law, rule, or regulation in connection with participation in the Promotion, tamper with the operation of the Promotion or engage in any conduct that is detrimental or unfair to Sponsor, the Promotion, or any other entrant (as determined in Sponsor's discretion) are subject to disqualification from the Promotion.

Sponsor, Google LLC; Meta Platforms, Inc.; their respective parent companies, subsidiaries, affiliates, suppliers, distributors, and prize suppliers, and any of these entities’ respective directors, officers, professional advisors, consultants, contractors, legal counsel, public relations firms, employees and advertising, fulfillment and marketing agencies (collectively, the “Released Parties”) will not be responsible for: (a) any late, lost, misrouted, garbled or distorted or damaged transmissions or entries; (b) phone, electronic, hardware, software, network, Internet, or other computer or communications-related malfunctions or failures; (c) any Promotion disruptions, injuries, losses or damages caused by events beyond the reasonable control of Sponsor or the Released Parties; or (d) any printing or typographical errors in any materials associated with the Promotion.

By participating in the Promotion, you unconditionally and forever release, discharge and agree to indemnify and hold harmless Sponsor and all Released Parties from any liability whatsoever, and waive any and all causes of action, related to any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Promotion or delivery, misdelivery, acceptance, possession, use of or inability to use the prize (including claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory even if such harm is caused solely by the recklessness, negligence, or fault of one or more Released Parties.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE SPONSOR AND THE RELEASED PARTIES BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOSS OF USE, LOSS OF PROFITS OR LOSS OF DATA, WHETHER IN AN ACTION IN CONTRACT, TORT (INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE) OR OTHERWISE, ARISING OUT OF OR IN ANY WAY CONNECTED TO YOUR PARTICIPATION IN THE PROMOTION OR USE OR INABILITY TO USE ANY EQUIPMENT PROVIDED FOR USE IN THE PROMOTION OR ANY PRIZE, EVEN IF A RELEASED PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL THE AGGREGATE LIABILITY OF THE RELEASED PARTIES (JOINTLY) ARISING OUT OF OR RELATING TO YOUR PARTICIPATION IN THE PROMOTION OR USE OF OR INABILITY TO USE ANY PRIZE EXCEED $10.

By participating in this Promotion, you certify that you have complied with these Official Rules and satisfy all of the eligibility requirements listed above. The use of the terms “includes,” “include” or “including” in these Official Rules is illustrative and not limiting.
